On April 2, 2025 the U.S. Citizenship and Immigration Services (USCIS) released and updated the I-9 Form, BUT employers can continue using the previous version of the form. I-9 Form Changes The term “noncitizen” was replaced with “alien” The term “gender” was replace with “sex” The new edition date is 1/20/25 The I-9 Form instructions also contain similar updates with a revised Department of Homeland Security (DHS) Privacy Notice. Starting April 3, 2025, these changes will also be reflected in E-Verify and E-Verify+. The Conclusion Because the new I-9 Form is optional, there is no need for action at this time. The previous version dated 8/1/23 is still valid (please note the two expiration dates of 2026 & 2027). Employers that use E-Verify and continue to use the earlier I-9 version of 8/1/23 should note the language difference referring to noncitizens. If an employee selects on the I-9 form that they are “a noncitizen authorized to work” the employer must select “an alien authorized to work” in E-Verify.
