In light of recent DHS/ICE enforcement actions, you should ensure your I-9’s are up to date, properly completed and maintained. Form I-9 confirms a workers’ identity and authorization to work in the U.S. and is required for all new employees. If it is found that any employee is not authorized to work, ICE will generally give the employer 10 days to rectify the issue or risk certain penalties. It is critical for employers to ensure they are prepared to provide all necessary documentation in the case of an audit. The USCIS has published guidelines intended to help employers conduct a proactive audit. https://www.ice.gov/doclib/guidance/i9Guidance.pdf A few key areas that are critical for the proper completion of an I-9: That the employee filled out the I-9 themselves in the employee portion and signed it The employer completed their portion of the I-9 and signed it No missing data fields The I-9 was completed and signed within 3 days of hire Documents used from list A are unexpired Reverification completed prior to work authorization expiration HRN also has a recorded training on Completing Your I-9’s, that is available to all clients.
